PATRICK HARLIN MUSIC RENTAL TERMS:
1. The Materials: The rental materials supplied will be either printed music parts shipped to you, or digital files supplied with permission to print copies for the specific performance(s) licensed under this Agreement. Where printed parts are supplied, it is the responsibility of the organization to inspect the materials upon receipt and to notify the Publisher of any missing or damaged materials.
2. Rental License: These materials, including digital files and printed performing materials are rented under license, not sold, and may be used only pursuant to the terms hereof.
3. Retention of Materials: Depending on the type of Rental specified above, your organization may be required to return the printed performance materials, or may retain the materials on loan subject to entering into a new Rental Agreement for each future performance. The Materials remain the property of the Publisher and must be returned upon demand. You may not loan or sell these materials to anyone for any purpose.
4. Licensed Uses: The Materials supplied here with a rented for live performances only and may not be used for radio or television broadcast, commercial or archival recording, transcription, translation, or any other use whatsoever without express advance written permission. Additional fees are payable for such uses and will be quoted upon request. This rental agreement grants no rights to record this work for any purpose.
5. Public Performance License: Possession of performing materials (score and parts) on loan from the publisher does not include a license for public performance, which must be secured through BMI (Broadcast Music Incorporated). Public performance without performance license is an infringement of copyright, even if rental fees have been paid. Performances of this work require both a Rental Agreement available from the publisher and a public performance license available from BMI. Organization promises to report all performances of the rented work to BMI and to supply concert programs pursuant to the terms of the BMI license.
6. No Adaptations: No arrangements, transcriptions, translations new visual elements, artwork, advertising posters or alterations of the work for which these materials are rented may be made without PATRICK HARLIN’s express advance written permission.
7. Cancellation Policy: If performances are cancelled after materials have been shipped, a cancellation fee will be charged.
8. Return of Materials: In the event return of the Materials is required, all return shipping charges, including Insurance, are the responsibility of the Organization renting the materials. Materials must be returned in the same condition received, well packed, insured at value stated, and prepaid. Markings in the master parts must be made in No. 2 lead pencil only. All markings other than corrections must be removed prior to return or a removal charge may be imposed.
9. Payment and Additional Charges: The license granted hereunder is contingent upon Publisher’s receipt of full payment, and may be revoked if full payment and/or any additional charges are not received pursuant to the due date(s) above.
10.Tickets, Programs and Archival Recordings: If requested, Publisher shall be provided with two (2) complimentary center section prime location seats for each performance. Three (3) copies of the printed program(s) for all performances hereunder must be supplied to the Publisher within fourteen (14) days of the last performance, along with any authorized archival recordings.
